The Spanish Agency for Food Safety and Nutrition (AESAN) established temporary action limits for MOAH in food.
In 2024 the Netherlands already decided to introduce temporary action limits.
To date no maximum limits have been established by the EU.
If the temporary action limits listed below are exceeded, in Spain the affected food products must be withdrawn from the market or recalled.
0.5 mg/kg for dry foods with low fat/oil content (≤ 4 % fat/oil)
1 mg/kg for foods with higher fat/oil content (> 4 % to ≤ 50 % fat/oil)
2 mg/kg for fats/oils or foods with a fat/oil content of > 50 %
Derogation until January 2028: Notwithstanding the above for the product category “fats/oils or foods with a fat/oil content of > 50%” a MOAH concentration of up to 10 mg/kg will be permitted for fats and oils under transitional conditions.
Please note that the scope of application covers all foodstuffs and that the action limits apply to products “as sold” regardless of the origin of contamination.
