Maximum levels for aromatic mineral oil hydrocarbons (MOAH) in food adopted!

On 13 May 2026, the draft amendment to Regulation (EU) 2023/915 concerning maximum levels of MOAH in food received a favourable vote in the Standing Committee on Plants, Animals, Food and Feed (SCoPAFF), Section “Novel Foods and Toxicological Safety of the Food Chain”.

The maximum levels will apply progressively from 2027, 2028 or 2030, depending on the specific food category.

Previously, the “Common Statement on the Presence of MOAH in Food, including Food for Infants and Young Children” issued by SCoPAFF on 21 April 2022, as clarified on 19 October 2022, applied, including the maximum LOQs (action levels) set out therein.

As of 13 May 2026, the future maximum levels are to be used as the benchmark for official controls.

Given that certain action levels in the Common Statement of 21 April 2022 are lower than the forthcoming maximum levels set out in the Regulation for the respective foods, the maximum levels defined in the Commission Regulation amending Regulation (EU) 2023/915 shall, from 13 May 2026, serve as the basis for enforcement in accordance with Article 14 of Regulation (EC) No 178/2002.

Once the new maximum levels officially enter into force, the 2022 statement will cease to apply – but only for those foods for which new maximum levels have been established. For foods without specified maximum levels, the previous provisions will remain applicable.
